第一章总则

第一条为加强我省干线公路建设工程安全生产管理，保障涉及干线公路建设工程的人民生命财产安全，依据《中华人民共和国安全生产法》、《建设工程安全生产管理条例》、《安全生产许可证条例》、《公路水运工程安全生产监督管理办法》、《江苏省交通建设工程安全责任制》等，结合我省干线公路建设的实际情况，制定本办法。

第二条本办法所指干线公路建设工程，是指列入全省干线公路建设工程年度计划的建设项目。

第三条干线公路建设工程安全管理工作必须认真遵守国家和我省有关工程项目安全设施“三同时原则”（即项目安全设施与主体工程同时设计、同时实施、同时投入使用）的规定，坚持“安全第一、预防为主、综合治理”的方针。

第四条干线公路建设工程安全生产管理实行统一监管、行业指导、分级负责。市级、县级地方人民政府交通主管部门负责本行政区域内干线公路建设工程安全生产的监督管理工作，并委托其设置的安全监督机构负责具体工作；省交通厅公路局按本办法负责全省干线公路建设工程安全生产的行业管理工作，各市公路管理处具体负责辖区内干线公路建设工程安全生产的行业指导工作。

第五条在我省境内从事干线公路建设工程活动的建设单位及从业单位（设计、施工、监理及其它与干线公路建设工程安全生产有

第二章建设单位的安全义务和责任

第七条建设单位应严格执行干线公路建设招投标程序，将工程发包给具有相应资质等级和安全生产许可证的从业单位。

第八条建设单位在工程招标文件中应当按照法律、法规的规定对施工单位的安全生产条件、安全生产信用情况、安全生产的保障措施等提出明确的要求。施工单位以往的安全生产业绩应作为其资格预审能否通过的重要条件和评标时衡量其企业管理水平高低的重要因素；施工单位中标后，建设单位应与其签订安全生产合同。

第九条建设单位在编制工程招标文件时应当确定工程项目安全作业环境及安全施工措施所需的安全生产费用(不低于建安费的1%)。安全生产费用由建设单位根据监理工程师对工程安全情况的签字确认进行支付。

第十条建设单位应结合本工程项目特点建立健全自身的安全管理机构，完善各项安全管理制度及安全事故应急预案。

工程正式开工前应向交通建设工程安全监督部门办理安全监督手续，并在项目实施过程中主动接受省、市安全管理、监督机构对项目安全生产的监督检查。若后续工程的从业单位尚未确定，建设单位可以向交通建设工程安全监督部门书面说明，待确定后再办理相关工

第十一条建设单位应按照国家和本省的有关规定以及与从业单位签订的安全合同对从业单位的安全行为加强管理，应督促从业单位建立健全安全保障体系、安全生产各项制度，落实安全生产责任制，并检查、督促其严格执行。

第十二条建设单位不得以任何理由要求设计、施工和监理单位违反有关建设工程安全生产的法律、法规、规章和标准、规范、操作规程的规定进行设计、施工及监理。

第十三条建设单位不得采用明示或暗示的方式，要求施工单位使用不符合安全施工要求的建筑材料、建筑构配件、安全防护用具、机械设备、施工机具及配件、消防设施和器材等。建设单位要创造条件加强安全生产教育培训，完善施工人员教育准入制度，组织施工人员学习安全警示教育，了解安全隐患。

第十四条涉及桥梁等构造物承重结构的设计变更，按照省交通厅公路局关于干线公路设计变更管理办法，办理审批手续。

第十五条特大桥、大桥及其它大型构造物，按国家规定危险性较大的工程或施工地点附近有大型易燃易爆设施等情况，建设单位应对施工单位编制的施工组织设计有关安全保障措施、安全应急预案等进行严格审查；必要时，可委托具有相应资质的咨询机构进行安全性评价并制定出相应措施。

第十六条建设单位应强化对拆除工程施工单位的资格审查；实施爆破作业的，要严格按照国家有关爆破作业的各项规定。

第十七条咨询、勘察、设计单位应当依法取得相应等级的资质证书，并在其资质等级许可的业务范围内承揽干线公路建设工程的咨询、勘察、设计任务。

第十八条在工程可行性或方案研究阶段，咨询或设计单位要对工程的实施及运营进行安全性评估。若项目具有较大安全风险，应对项目的安全生产条件及安全设施进行专门论证，提出相应的安全应对方案；若项目安全风险较小，则应对项目的安全生产条件及安全设施进行综合分析的基础上，编制安全专篇。

第十九条勘察单位应严格执行工程建设相关安全法律、法规和工程建设强制性标准，按照工程建设标准及建设单位要求规范勘察行为。

第二十条勘察单位应建立健全勘察安全生产制度及安全保障措施，现场勘察从业人员须按规定持证上岗，加强对现场勘察人员的安全教育和培训。在勘察作业时，应当严格执行操作规程，采取措施保证人员、各类管线、设施和周边建筑物、构造物的安全。

第二十一条勘察单位在工程所在区域地质灾难严重或工程建设活动可能引发地质灾害时，应向建设单位提供地质灾害防治措施和建议。

在工程施工过程中，当出现勘察报告中提出的相关安全问题时，应积极配合建设、设计、监理、施工单位采取安全措施。

第二十三条干线公路建设工程采用新结构、新材料、新工艺和特殊结构设计时，设计单位应当在设计文件中提出保障施工作业人员安全和预防施工安全事故的措施和建议。

第二十四条设计单位应就审查通过的设计文件向建设、施工、监理单位进行安全设施、安全施工措施等方面技术交底。在施工过程中，应积极配合建设单位与设计相关的安全管理工作，按建设单位要求，对提出的不能满足施工作业安全条件的工程设计文件及时进行变更，并出具变更设计图纸。

第四章施工单位的安全义务和责任

第二十五条施工单位从事干线公路建设工程，应依法取得相应等级的资质证书及安全生产许可证，并在其资质等级许可的范围内承揽工程，施工中严格执行安全生产的各项要求。

第二十六条施工单位应当建立健全安全生产责任制。施工单位的法定代表人是本单位安全生产的第一责任人，对本单位的安全生产全面负责；分管安全生产工作的负责人对本单位的安全生产负领导责任；项目经理是工程项目安全生产的第一责任人，对本项目的安全生产负全面责任。

专职安全生产管理人员负责对安全生产进行现场监督检查，并做好检查记录，发现安全生产事故隐患，应当及时向项目负责人和安全生产管理机构报告，对违章指挥、违章操作和违反劳动纪律的，应当立即制止。

第二十八条施工单位应当按照有关法律、法规和标准、规范组织施工，根据工程项目特点制定各项安全生产管理制度，建立健全会议制度，隐患排查和内业台帐制度，操作规程和有针对性的安全施工技术保障措施或方案，编制安全生产事故应急预案，经本单位安全和技术部门审核、技术负责人批准后，报监理单位和相关单位审批后实施。本办法第十五条所列具有较大安全风险施工的安全保障措施和方案、安全生产事故应急预案还须报备建设。

第三十七条施工单位对与工程相关的供水、排水、供电、供气、供热、邮电通讯、光纤、军事光缆等地下管线以及工程施工可能造成损害的毗邻建筑物、构造物等，应当事先告知相关部门及时迁移或采取相应保护措施。

第三十八条施工单位应当建立设备进场验收登记制度。按照《公路水运工程安全生产监督管理办法》，施工单位在工程中使用起重机械和整体提升脚手架、滑模爬模、架桥机等自升式架设设施前，应当组织有关单位进行验收或委托具有相应资质的检验检测机构进行验收，并按相关规定完善登记手续。使用承租的机械设备和施工机具及配件的由承租单位和安装单位共同组织验收，验收合格的方可使用。验收合格后3天内，应当向当地交通主管部门登记。

第四十一条施工单位应当将施工现场的办公区与生活区分离设置，同时与作业区保持安全距离。职工的膳食、饮水、休息场所等应当符合卫生标准，办公区及生活区用电、消防等应符合相关规定。施工现场临时搭建的建筑物应当符合安全使用要求。

第四十二条施工人员在施工过程中应当达到以下安全作业要求：

第五十四条监理单位还应对施工单位以下方面重点加强检查：（一）安全管理体系的组织机构，包括项目经理、专职安全管理人员、国家及地方规定的特种作业人员配备的数量及安全资格培训持证上岗情况；

（二）施工安全生产责任制度、安全管理规章制度、安全操作规程的制定及落实情况；

（三）施工现场临时用电及消防措施的制定及落实情况；（四）施工单位安全培训教育、安全技术交底及危险告知制度的执行情况；

（五）施工单位的安全防护用具、机械设备、施工机具是否符合国家有关安全规定；

（六）施工现场安全标志、标牌、路锥等安全设施的设置数量、规格、位置是否符合国家有关安全规定；

（七）施工单位安全日常自查自纠情况；

（八）施工现场、生活区、办公区布置是否符合有关安全要求，职工食堂是否执行相关卫生标准；

第五十六条监理人员应加强对危险性较大工程的巡视检查，在巡视、旁站过程中应监督检查施工单位是否按施工组织设计编制的安全技术措施或专项施工方案组织施工，若发现施工单位未按有关安全法律、法规和工程强制性标准违规施工作业时，应予以制止，必要时可下达施工暂停指令并向建设单位和有关部门报告。

对危险性较大的工程施工作业等应实行全过程旁站监理。第五十七条监理单位应督促施工单位进行安全生产自查工作，落实施工生产安全技术保障措施和各项安全管理制度，积极参加施工现场安全生产管理的各项活动。

第五十九条监理单位应当建立施工安全监理台账，填报安全监理日志和监理月报，并有专人负责，总监理工程师和驻地监理工程师应定期检查施工安全监理台帐记录情况。

第六十条监理单位应当积极配合建设单位及有关安全生产监督管理机构的各种检查工作。

第六章行业管理单位的安全义务和责任

第六十一条行业管理单位应自觉接受省、市安全生产监督管理部门的业务指导，贯彻执行国家、交通部及我省有关交通建设工程安全生产的法律、法规、方针、政策及技术标准，对干线公路建设工程从业单位进行定期或不定期检查或抽查。

第六十二条行业管理单位应当建立健全自身的安全管理机构，完善各项安全生产制度及安全事故应急预案，定期或不定期对进行检查，并做好安全检查记录。

第六十三条行业管理单位应当建立举报制度，公开举报电话、信箱或电子邮件地址，受理有关干线公路建设工程安全生产的举报。任何单位和个人有权对干线公路建设工程安全事故及隐患检举、控告，省、市相关安全生产行业管理单位收到检举、控告后，应及时处理。

（一）要求被检查单位提供有关工程安全生产的文件资料；（二）进入被检查单位或者施工现场进行检查；

（三）发现违反安全生产规定的行为时，当场予以纠正或者要求限期整改；

（四）对检查中发现的事故隐患，应当责令立即排除；重大事故隐患排除前或排除过程中无法保证安全的，应当责令施工作业人员立即从危险区域内撤出，暂时停止施工。

第六十五条行业管理单位应对其管辖范围内的干线公路建设工程从业单位安全监督检查情况作好记录，并将其纳入从业单位履约考核记录，以作为干线公路建设工程招标投标、资格预审的重要条件以及评标时衡量其企业管理水平高低的重要因素。

第七章附则

第六十六条本办法由省交通厅公路局负责解释。第六十七条本办法自发布之日起试行。
