烟草专卖行政处罚规定

第一条 为了贯彻实施《中华人民共和国烟草专卖法》（以下简称《烟草专卖法》），制定本规定。

第二条 各级烟草专卖行政主管部门负责本规定的贯彻执行。在查处违反《烟草专卖法》的案件时，可以行使下列职权：

（一）询问违法案件的当事人、嫌疑人和证人；

（二）检查违法案件当事人的财物，对其中的烟草专卖品可以扣留；

（三）调查违法案件当事人的行为和有关的活动；

（四）查阅、复制、扣留与违法活动有关的合同、发票、帐册、单据、记录、文件、业务函电和其他资料。

第三条 烟草专卖行政主管部门或者会同有关部门可以在车站、码头及交通要道对非法运输烟草专卖品的活动，依法进行检查。

第四条 烟草专卖行政主管部门的专卖管理检查人员依法进行检查时，必须出示省级以上（含省级，下同）烟草专卖行政主管部门核发的检查证。

第五条 烟草专卖行政主管部门工作人员依法行使职权，不受非法干预。

第六条 省级以上烟草专卖行政主管部门可以根据需要设立派出机构或者派驻人员，负责监督、检查、协调烟草专卖品的生产、经营、管理工作，依法查处重大违法案件。

第七条 擅自收购烟叶，依照《烟草专卖法》第三十条规定处罚的，按其所收购烟叶总值百分之五十以上、一倍以下的标准处以罚款，并按照国家规定的收购价格的百分之七十收购其违法收购的烟叶；擅自收购烟叶超过二千公斤的，视为数量巨大，依法没收其违法收购的烟叶和违法所得。

第八条 无准运证托运、自运烟草专卖品，依照《烟草专卖法》第三十一条规定处罚的，按照其违法运输的烟草专卖品总值百分之二十以上、百分之五十以下的标准处以罚款；并可以按照国家规定的价格的百分之七十或者当地市场价的百分之七十收购违法运输的烟草专卖品。

有下列情形之一的，视为情节严重，依法没收违法运输的烟草专卖品和违法所得：

（一）运输的烟草专卖品价值超过五万元或者运输卷烟数量超过二百件（万支／件）的；

（二）被烟草专卖行政主管部门处罚两次（含两次）以上，屡教不改的；

（三）使用改装、伪装运输工具逃避检查的；

（四）其他情节严重的行为。

超过准运证规定的数量，或者使用过期、复印、涂改、变造、伪造等无效的准运证托运或者自运烟草专卖品的，以及个人异地超限量携带烟草制品的，依照本条第一款、第二款规定处理。

承运人明知是烟草专卖品而为无准运证的单位、个人运输的，没收违法所得，并处以违法运输的烟草专卖品总值百分之二十以下的罚款。

第九条 无烟草专卖生产企业许可证生产烟草制品、卷烟纸、滤嘴棒、烟用丝束或者烟草专用机械，依照《烟草专卖法》第三十二条规定处罚的，按照下列规定执行：

（一）无烟草专卖生产企业许可证生产烟草制品的，责令关闭，没收违法所得，并处以所生产烟草制品总值一倍以上、两倍以下的罚款；

（二）无烟草专卖生产企业许可证生产卷烟纸、滤嘴棒、烟用丝束或者烟草专用机械的，责令停止生产上述产品，没收违法所得，并

可处以所生产烟草专卖品总值一倍以上、两部以下的罚款。

第十条 无烟草专卖批发企业许可证经营烟草制品批发业务，依照《烟草专卖法》第三十三条规定处罚的，按照其批发总额百分之二十以上、百分之五十以下的标准处以罚款，并责令关闭或者停止经营烟草制品批发业务，没收违法所得。

有下列情形之一的，视为无证批发，按前款规定处罚：

（一）无烟草专卖批发企业许可证的单位或者个人，一次销售卷烟超过四十九条或者价值一千元以上的；

（二）无烟草专卖批发企业许可证的单位或者个人，向领有烟草专卖零售许可证的单位和个人提供货源的。

第十一条 无特种烟草专卖经营企业许可证经营烟草专卖品进出口业务、外国烟草制品寄售业务或者免税的外国烟草制品购销业务，依照《烟草专卖法》第三十四条规定处罚的，责令停止经营上述业务，没收违法所得，并按照下列规定处以罚款：

（一）无特种烟草专卖经营企业许可证经营烟草专卖品进出口业务的，处以违法经营的烟草专卖品总值一倍以上、两倍以下的罚款；

（二）无特种烟草专卖经营企业许可证经营外国烟草制品寄售业务或者免税的外国烟草制品购销业务的，处以违法经营的烟草制品总值百分之二十以上、两倍以下的罚款。

第十二条 未经国务院烟草专卖行政主管部门批准，烟草制品生产企业擅自为扩大生产能力进行基本建设或者技术改造的，处以其投资总额百分之十以上、百分之二十以下的罚款，并没收其为扩大再生产而购置的设备。

第十三条 烟草制品生产企业生产不合格烟草制品的，给予警告或者责令停产整顿。

第十四条 不按规定跨省购销卷烟、雪茄烟的，对购销双方各处以相当批发总额百分之十以上、百分之二十以下的罚款。 第十五条 被委托的批发企业不按委托规定范围进货的，没收违法所得，并处以其进货总额百分之二十以上、百分之五十以下的罚款。

烟草专卖品生产、批发企业（包括被委托的批发企业）为无烟草专卖许可证的企业或者个体工商户提供货源的，或者不按规定跨地区

供货的，没收违法所得，并处以其销售总额百分之二十以上、百分之五十以下的罚款。

第十六条 销售霉坏、变质烟草制品的，责令其销毁霉坏、变质的烟草制品，并处以其销售额百分之十以上、百分之二十以下的罚款。

第十七条 烟草制品生产企业从无烟草专卖生产、经营企业许可证的企业购买卷烟纸、滤嘴棒、烟用丝束或者烟草专用机构的，没收其违法购买的烟草专卖品，并处以所购烟草专卖品等值以下的罚款。

第十八条 领有烟草专卖许可证的企业或者个体工商户，违反烟草专卖法律、法规，经教育、处罚不改的，原发证机关可以吊销其烟草专卖许可证。

第十九条 本规定由国家烟草专卖局解释。

第二十条 本规定自发布之日起施行。


